WANTED: Newburgh Man Arrested for Shooting Child Enjoys Release, Goes on the Lam

A man arrested for shooting two people in the City of Newburgh, one of which was a child, has gone on the lam and the District Attorney is asking for the public’s help to find him. The maniac allegedly went on a crime spree last month and has now vanished after being set free under New York State’s pro-crime Bail Reform Act – twice!

John DiCaprio, age 21 of Newburgh, failed to appear in Orange County Court today in connection with a series of crimes in December, part of which included shooting two people.

Following two separate arrests, DiCaprio was entitled to be sprung with nearly no bail each time. Then, he declined to appear in court on Wednesday. A judge issued another warrant hoping DiCaprio would have a change of heart. However, DiCaprio declined and did not show up again. He has now vanished.

The Orange County District Attorney’s Office and the City of Newburgh Police are now requesting the public’s help in locating the dangerous lunatic.

DiCaprio’s alleged crime spree last month lasted over a two day period.

On December 15, 2022, the City of Newburgh Police Department charged DiCaprio with illegally possessing a .45 caliber revolver and a Glock .380 caliber semiautomatic pistol while in a car.  Each of those handguns were loaded and one of them had the serial number removed. He was charged with two counts of Criminal Possession of a Weapon in the 2nd degree and one count of Criminal Possession of a Weapon in the 3rd degree. 

At the arraignment, the District Attorney’s Office recommended that bail be set in the amount of $100,000.00 cash, $500,000.00 secured bond or $750,000.00 partially secured bond to ensure that DiCaprio would continue to appear on the charges. Instead, the judge set bail in the amount of $5,000.00 cash, $50,000.00 secured bond or $50,000.00 partially secured bond. DiCaprio posted the bail. 

Two days later, on December 17, 2022, DiCaprio was again arrested by the City of Newburgh Police Department. It was alleged that on December 10, 2022, he fired a handgun at an adult, striking him in the leg. A nearby child was also shot. DiCaprio was charged with Attempted Assault in the 1st degree and Criminal Possession of a Weapon in the 2nd degree.

At that arraignment, the District Attorney’s Office recommended that bail be set in the amount of $100,000.00 cash, $500,000.00 secured bond or $750,000.00 partially secured bond to ensure that DiCaprio would continue to appear on the charges.  Instead, the judge set bail in the amount of $10,000.00 cash, $50,000.00 secured bond, or $75,000.00 partially secured bond. DiCaprio again posted the bail.  

Now he has gone missing.

All the charges were presented to an Orange County Grand Jury, which indicted the lunatic. He was scheduled to appear in County Court to be arraigned on the indictment on January 11, 2023 but failed to appear.

As required under State laws advocating for criminals, the Orange County Court Judge issued an arrest warrant and hoping that DiCaprio would appear in court today. Since he did not, another arrest warrant has been issued.

Orange County District Attorney David M. Hoovler thanked the City of Newburgh Police Department for their investigation and the arrests of DiCaprio.  Both the District Attorney’s Office and the City of Newburgh Police Department are requesting the public’s help in locating DiCaprio.

 “It is well known that those who are convicted of illegal weapons possession and the illegal use of weapons can expect significant sentences in Orange County,” said Hoovler. “Bail which is sufficient to ensure that a defendant returns to court must take into account the seriousness of the offense and a defendant’s incentive to not return to court. Illegally possessed firearms lead to violence on our streets. I urge anyone with information concerning John DiCaprio’s location to contact the City of Newburgh Police Department.”
